1. Introduction

By using ChatSpark (“Service”), you agree to the following terms and conditions. If you do not agree, please refrain from using the Service.

2. Description of the Service

ChatSpark provides an AI chatbot creation service for websites. The chatbot operates 24/7 and is trained based on user-selected content sources.

3. User Obligations

Users must ensure that the data provided to train the chatbot does not infringe on any copyrights or contains sensitive personal data. Users are responsible for the accurate representation and use of the chatbots on their website(s).

4. Data Handling

ChatSpark only hosts the content used for training chatbots. We do not store external website data or documents.

Users grant ChatSpark permission to process and utilize the provided data for the sole purpose of chatbot training and operation.

5. Service Plans and Pricing

ChatSpark offers various subscription tiers. Each tier has a distinct set of offerings, message limits, and pricing as described on our Pricing page.

Users are billed according to their chosen subscription plan and any extra services utilized.

Refunds are not available due to service operation costs.

6. Limitations and Boundaries

A ChatSpark chatbot's accuracy depends on the quality and completeness of the training data.

ChatSpark chatbots are limited to the message and page count specified by the user's subscription plan.

Users may not assign a single chatbot to multiple websites but may create multiple chatbots with the same data.

7. Branding

The “Powered by ChatSpark” branding is present on all chatbots, excluding those subscribed under the Enterprise plan.

8. Feedback and Continuous Improvement

Users are encouraged to provide feedback. This feedback may be utilized by ChatSpark to enhance the Service.

9. Subscription and Cancellation

If a user chooses not to continue after the trial period, it is their responsibility to cancel the subscription via their account dashboard.

Chatbots associated with a user will be deleted at the end of their billing cycle upon cancellation.

10. Service Disruption

ChatSpark is not liable for any business disruption, loss of revenue, or dissatisfaction caused by the chatbot's responses or lack of availability.

11. Modification of Terms

ChatSpark reserves the right to modify these terms and conditions. Users will be notified of any significant changes.

13. Governing Law

These terms and conditions shall be governed by and construed in accordance with the laws of the State of California. Disputes arising shall be exclusively subject to the jurisdiction of the state and federal courts located in San Diego, California.
